It is becoming increasingly more common to see in-house counsel appearing
as defendants in legal malpractice claims. Companies are leaning on their
in-house counsel for activities previously sent to outside firms, in-house
counsel may provide pro bono services to clients inside or outside the
corporation, and some lawyers engage in private practice outside the office,
in activities known as "moonlighting." Employed Lawyer's Professional Liability
Insurance offers protection for the activities of the counsel as an attorney-
it covers both the individual lawyers and their corporations.
Standard features in many of the policies include:
- Up to $10 million in limits of liability
- Insures a company's legal department, individual counsel and employed
lawyers providing corporate, pro bono and/or moonlighting services of
a legal nature against claims of actual or alleged breach of duty, negligence,
errors or omissions
- Insures the employer in the event they must indemnify an employed
lawyer
